These Terms & Conditions apply to purchases from VAN DER SANDE.

1. Works

VAN DER SANDE offers original artworks, one-of-a-kind Light Works and other unique objects.

Due to the handmade, artistic, vintage or reimagined nature of certain works, variations, irregularities, traces of age and characteristics of materials may form part of the work and are not necessarily defects.

Every effort is made to represent works accurately. Colours, textures, scale and appearance may nevertheless vary depending on photography, lighting and screen settings.

2. Availability

Unless otherwise stated, works are unique and available in a single example.

An enquiry does not reserve a work. A work is only reserved or sold once this has been expressly confirmed by VAN DER SANDE.

3. Purchases

Submitting an enquiry does not in itself constitute a purchase.

Before a purchase is concluded, the buyer will be informed of the relevant price and any applicable delivery or other additional costs.

A purchase becomes binding once the purchase has been expressly agreed and confirmed, subject to any mandatory consumer rights under applicable law.

4. Prices

Prices are stated in euros and include VAT where applicable, unless expressly stated otherwise.

Delivery, installation or other additional services are not included unless expressly specified.

5. Payment

Payment must be made using the payment method agreed with VAN DER SANDE.

Unless otherwise agreed in writing, full payment is required before a work is released, collected or delivered.

6. Light Works: Product Information & Safety

VAN DER SANDE Light Works are one-of-a-kind objects created through the artistic reinterpretation of existing lighting pieces. Each Light Work may incorporate original electrical components alongside newly added decorative materials and finishes.

Light Works are intended for indoor use only.

Light Sources & Heat Safety

VAN DER SANDE Light Works are intended for use with suitable LED light sources only. The appropriate LED type and maximum permitted wattage will be specified individually for each Light Work before it is supplied for use as functioning lighting.

Adequate ventilation around the light source must be maintained at all times. Decorative materials must not come into contact with the light source or obstruct heat dissipation.

Incandescent and halogen bulbs must not be used.

Care & Use

Customers should not modify the electrical components or decorative elements. If unusual heat, odour or any other sign of malfunction occurs, the Light Work must be switched off and disconnected immediately.

Any additional care and usage instructions specific to an individual Light Work will be provided where applicable.

Nothing in these terms excludes or limits any applicable statutory consumer rights.

7. Ownership

Ownership of a work remains with VAN DER SANDE until the full purchase price and any agreed additional charges have been received.

8. Intellectual property

Purchase of a work transfers ownership of the physical work only.

Copyright and other intellectual property rights relating to works created by VAN DER SANDE or LILAS remain with their respective rights holders unless expressly agreed otherwise in writing.

Purchasing a work does not grant the buyer the right to reproduce, commercially exploit or create derivative products from the work.

9. Commissions and bespoke works

Commissioned or bespoke works are developed specifically for the client.

The scope, price, payment arrangements and relevant specifications will be agreed before work begins.

Where a work is made to the consumer's individual specifications or is clearly personalized, the statutory right of withdrawal may not apply where the legal requirements for that exception are met.

10. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Subject to mandatory law, VAN DER SANDE is not responsible for damage resulting from improper handling, installation, modification, storage or use of a work contrary to instructions supplied with it.

11. Applicable law

These Terms & Conditions are governed by Dutch law. Any mandatory consumer protections applicable to the buyer remain unaffected.
